In consideration of and as an inducement to my enrollment and payment of fees to become a member of MXVE, LLC, I represent and agree as follows:
MXVE, LLC may at its sole discretion suspend or terminate the rights of Members for any reason.
I understand that exercise, training and using fitness equipment are potentially hazardous activities. I further understand that these activities involve risks of injury, aggravation of preexisting conditions, and in the most severe and extreme situations, even death. Furthermore, I acknowledge that the effect of exercise on the body cannot be predicted with complete accuracy and that injuries may occur during or following exercise that could lead to these complications and adversely affect my health. These changes may include, among other effects, high blood pressure, increased heart rate, altered heart function, and possibly, and again in rare instances, cardiac complications. Accordingly, I acknowledge that I am voluntarily participating in these activities with the full knowledge and understanding of the potential dangers. I am aware that a comprehensive medical examination is necessary before using the facility, equipment and machinery and that a consultation with a physician is essential to determine which physical activities, exercises, training and programs, if any, are recommended by my personal doctor. I further acknowledge that I have either had a physical examination within the last month and learned of the recommended activities, or that I voluntarily assume all responsibility and liability for using the facilities, equipment, machinery and participating in all programs at MXVE, LLC. I also have read and been informed of the following warning and notification: If you are currently under a physician’s care for an injury, condition or illness, MXVE, LLC strongly urges you to consult your physician before conducting any exercises, using any equipment, or participating in any program at MXVE, LLC. Whether I have had an examination or voluntarily assume all liability I further declare that I am physically fit, sound and suffering from no condition, impairment, disability, disease, infirmity, or illness that should prevent my participation in any program, the use of any exercise, and the use of equipment and machinery. (Anyone who cannot sign that this statement is correct must see a manager at MXVE, LLC immediately before using the facilities). Moreover, in consideration of being allowed to use all facilities, equipment, machinery and programs, I personally assume all risks involved in all exercising, training, activities and programs at MXVE, LLC. I also waive and release, now and forever, all claims and causes of action against MXVE, LLC, its elected or appointed officers, agents, volunteers, employees, representatives, consultants, executors, and all others directly or indirectly connected with MXVE, LLC from any and all personal injuries I sustain (including death), any medical condition of any kind which results, any aggravation of a pre-existing medical condition that I aggravate, and any and all other damages or injuries which I sustain in any way from the direct or indirect result of my activities, exercise, training and participation in at MXVE, LLC. I further hold MXVE, LLC harmless from any loss to personal property which is lost or stolen while I use, or are present at MXVE, LLC while, during, going to, or going from MXVE, LLC.

Disclaimer and Sexual Misconduct Policy

In consideration of and as an inducement to my enrollment and payment of fees to become a participant of MXVE, LLC, I represent and agree as follows:

(1) Registration fees and Tuition for classes paid hereafter are non-refundable. MXVE, LLC may at its sole discretion suspend or terminate the rights of Members for any reason.

(2) Any dispute arising out of or relating to this Participant Application and Hold Harmless Agreement, or the breach thereof, shall be finally resolved by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment upon the arbitration award may be entered in any court having jurisdiction.

(3) Any provision not in conformity with the law of any state or governing body having jurisdiction is hereby severed from this contract and the remaining provisions remain enforceable.

(4) MXVE, LLC strives to create a fitness focused community that promotes the health and safety of our guests and employees. S.W.E.T. fully supports federal, state, and local laws pertaining to drugs, alcohol and weapon. Possession or use of drugs, alcohol and weapons is strictly prohibited in all MXVE, LLC facilities and MXVE, LLC activities.

(5) MXVE, LLC is committed to the prevention of and appropriate response to sexual misconduct. Sexual misconduct is unlawful. MXVE, LLC does not tolerate sexual misconduct in any form. Every student, staff and faculty member has a responsibility to ensure that sexual misconduct does not occur. MXVE, LLC wishes neither to engage in victim blaming or rushing to judgement. Therefore, without judgement, we refer to anyone who reports that she or he has experienced sexual misconduct as a “Complainant” and to anyone who reportedly has engaged in Sexual Misconduct as a “Respondent”. Anyone found to have engaged in sexual misconduct towards a student or other person at MXVE, LLC may include an apology, counseling or dismissal. Reports of sexual misconduct will be treated promptly, seriously and confidentially. Complainants have the right to have a supporter or representative chosen by them involved in the process. They also have the option to stop the process at any time. Complainant always maintains the right to report any sexual misconduct to law enforcement. The Respondent also has the right to have a supporter or representative chosen by them present when she or he responds to the allegations made. Complicity, understood as assisting, facilitating or encouraging the commission of a violation of this policy as well as retaliation are also violations of the policy. MXVE, LLC understands retaliation as acts or attempted acts for the purpose of interfering with any report, investigation or proceeding under the policy, or as retribution or revenge against anyone who has reported sexual misconduct or who has participated (or expected to participate) in any manner in an investigation or proceeding under this policy.

Sexual misconduct includes but is not limited to the following:
• Sexual assault
• Sexual exploitation
• Sexual harassment
• Stalking
• Indecent exposure
• Voyeurism
• The distribution of a sexually explicit photograph or video of a person to one or more persons other than the person in the photograph or video without the consent of the person in the photograph or video and with the intent to distress the person in the photograph or video.

Photo Release

For good and valuable consideration, the receipt of which is hereby acknowledged, I hereby grant MXVE, LLC permission to use my likeness in a photograph in any and all of its publications, including but not limited to all of MXVE, LLC’s printed and digital publications. I understand and agree that any photograph using my likeness will become property of MXVE, LLC and will not be returned.

I acknowledge that since my participation with MXVE, LLC is voluntary, I will receive no financial compensation.

I hereby irrevocably authorize MXVE, LLC to edit, alter, copy, exhibit, publish or distribute this photo for purposes of publicizing MXVE, LLC’s programs or for any other related, lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising out of, or related to, the use of the photograph.

I hereby hold harmless and release and forever discharge MXVE, LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I am at least 18 years of age and am competent to contract in my own name. I have read this release before signing below and I fully understand the contents, meaning, and impact of this release.
